Terms of Service

These Terms of Service (“Terms”) govern your use of the Pacesmith mobile application (“App”) provided by Pacesmith (“we”, “us”, or “our”).

Acceptance of Terms

By downloading, installing, or using Pacesmith, you agree to be bound by these Terms. If you do not agree, do not use the App.

License

We grant you a limited, non-exclusive, non-transferable, revocable license to use Pacesmith for personal, non-commercial purposes on any Apple device you own or control, subject to the Apple Media Services Terms and Conditions.

In-App Purchase

Pacesmith offers a one-time in-app purchase to unlock additional features (Race Predictor, Pace Calculator, and Split Planner). This purchase is processed by Apple through the App Store. All billing inquiries and refund requests should be directed to Apple. The purchase is non-consumable and transfers across devices signed into the same Apple ID.

Accuracy of Calculations

Pacesmith uses the Daniels-Gilbert VDOT formula to provide training pace estimates. These calculations are based on established sports science but are estimates only. They should not be used as a substitute for professional coaching or medical advice. We do not guarantee the accuracy of any calculation for your specific circumstances.

Intellectual Property

Pacesmith and all related content, features, and functionality are owned by us and are protected by copyright and other intellectual property laws. The VDOT methodology was developed by Dr. Jack Daniels and is used under fair-use principles for calculation purposes.

Limitation of Liability

To the maximum extent permitted by law, Pacesmith shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the App. Our total liability shall not exceed the amount you paid for the App.

Termination

We may terminate or suspend your access to the App at any time, without notice, for conduct that we believe violates these Terms or is harmful to other users or us.

Changes to Terms

We may update these Terms from time to time. We will notify you of changes by updating the “Last updated” date on this page. Continued use of the App after changes constitutes acceptance of the new Terms.

Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to conflict of law provisions.
